This policy sets out AbayaFemme’s privacy protection policy for its e-commerce site, accessible:

(Hereinafter the “Site” or the “site”).

AbayaFemme respects your concerns regarding the confidentiality of personal data and information processed when you browse our Site. This policy tells you more about the nature and use of the personal information that you provide to us on the Site, the origin and use of browsing information processed when you browse our Site and, finally, your rights.

This policy is therefore important for you, as you wish to have a positive and confident experience of our services, and for us, as we wish to answer your questions accurately and fully and take your wishes into account.

This policy supplements the Site’s “Legal Notice and Terms of Use” and “Terms and Conditions of Sale” and applies to all personal information and browsing data collected and processed during your visit to our Site. By using our Site, you declare that you accept the terms of this policy.

1.General information

Through its Site, AbayaFemme may collect personal data provided in particular when an account is created on our site, Orders are placed, users register for our loyalty programme, reviews are written or Posts are published on our social networks.
This automated processing of information, in particular the management of visitors’ email addresses, has been declared to the CNIL (declaration No. 1988754 v 0).

The personal data collected by AbayaFemme is collected, processed, recorded and stored in accordance with the legal provisions in force in France.

2.Rights of access, rectification, deletion and objection to processing

You have a right of access, rectification and objection on legitimate grounds in respect of personal information concerning you, as well as the option to object to processing for direct marketing purposes, particularly commercial marketing. You may exercise these rights at any time by writing to AbayaFemme Customer Services at: infoabayafemmecom
– or via the unsubscribe link at the bottom of each email sent by AbayaFemme.
In accordance with the aforementioned French Data Protection Act, such requests for access, rectification or objection must be made by means of a letter (email) signed by its author and accompanied by a photocopy of an identity document bearing the signature of the person exercising their right.

3.Management of personal data by our company

3.1 Methods of collecting data

When you register on the Site, we collect personally identifiable data using the form available under “create an account”. AbayaFemme may thus collect your surname, first name, date of birth, email address and IP address (or the UDID of your mobile phone, where applicable). Only your title, first name, surname and email address are mandatory data for processing your registration. In addition, we may ask you to provide optional information such as your product/service preferences.

When placing an Order as defined in the Terms and Conditions of Sale, we collect personally identifiable data using the form available under “confirm order”. In this context, in addition to the data collected during registration and listed above, we collect: your postal address (billing and delivery addresses if different), your telephone number so that we can contact you in the event of a delivery problem, and information relating to the payment method (including bank card number and bank card holder). By ticking the box provided for this purpose, we may also retain your bank details (card type, card number, expiry date) so that you do not have to enter them again for future Orders. In this case, your bank card security code is not retained by AbayaFemme. You may also delete this information at any time by going to the “account” section. If your account data is not deleted, it remains on record until the bank card expires.
Subject to your rights, when you place an Order online, we may also collect information relating to the device used to place the Order (including the operating system used, the location of the machine and whether or not a proxy is used, etc.).

– If an Order is paid for at the till in a “AbayaFemme Flash” shop, in order to guarantee the confidentiality of your personally identifiable data, this data is collected directly by our sales advisers. They will ask you for the information required to pay for and deliver your Order, namely your surname, first name, email address and postal address.

You may, however, remove or amend this data in your account at any time.

Generally, the information that we collect and that is essential for us to respond to your requests is identified by an asterisk on collection forms or stated as such verbally when it is collected. If you do not complete these mandatory fields, we will be unable to respond to your requests.

Finally, when you request to view pages on the Site, AbayaFemme’s servers automatically recognise your computer’s IP address (this is the number that identifies each computer connected to the Internet. The IP address takes the following form: XXX.XXX.XXX.XXX, or your phone’s UDID (this is a number that identifies the phone model connected to the Internet. The UDID consists of forty characters)”).

3.2 Purposes

The personal data that we collect from you during any visit or Order is necessary for the use of the services offered on the Site and/or the management of your Order by AbayaFemme and its service providers, including the detection of online and payment fraud, the prevention and management of payment incidents (including unpaid amounts), the preservation of AbayaFemme’s rights in connection with its commercial activity and the management of the Loyalty Programme.

In addition, subject to your rights, your data may be used to inform you by email about products, services and offers provided by AbayaFemme.

Furthermore, we reserve the right to compile and publish generic information relating to the profiles of visitors to our site, without, however, including personally identifiable data such as visitors’ names and addresses.

We may also collect statistical information in order to understand how visitors use the Site (frequency with which the various Site pages are viewed, sales statistics and the origin of Site visitors, etc.).

Information relating to visitor profiles is retained by AbayaFemme and will only be used internally, particularly to conduct market research.

Finally, through AbayaFemme, a visitor who has expressly given prior consent may receive by email commercial offers concerning products or services supplied by AbayaFemme’s business partners or originating from them.

3.3 Data retention

Data is retained for a period that does not exceed the time necessary for the purposes for which it was collected.

3.4 Data recipients

The personal information provided is intended for AbayaFemme.

Personal data collected through the site may be transmitted to partner companies, in particular to enable the purposes set out above to be carried out, as well as to detect payment fraud, manage loyalty cards and manage marketing operations organised by AbayaFemme or its partners.
In particular, as part of efforts to combat online fraud, information relating to the Buyer’s Order, together with information relating to the Buyer’s device used to place the Order (including the operating system used, the location of the machine and whether or not a proxy is used), may be transmitted to any third party authorised by law or appointed by AbayaFemme solely for the purposes of verifying the Buyer’s identity, the validity of the Order, the payment method used and the proposed delivery.

Personal data – excluding photographs – may be transmitted to companies domiciled in countries that do not ensure an adequate level of protection within the meaning of Directive No. 95/46/CE. In this case, where possible, AbayaFemme enters into agreements with the recipients concerned to ensure an adequate level of protection, in accordance with the contractual clauses approved by the European Commission and the CNIL.

3.5 Data security and confidentiality

AbayaFemme has endeavoured to put in place all appropriate precautions to preserve the confidentiality and security of the personal data processed and to prevent it from being altered, damaged or destroyed, or accessed by unauthorised third parties. State-of-the-art technical and organisational security measures have been introduced, particularly with regard to information systems. However, the company does not control all the risks associated with the operation of the Internet and draws visitors’ attention to the possible risks inherent in its use and operation.

4.Cookies and connection trackers

4.1 What is a “Cookie”?

A “Cookie” or tracker is a text file that may be stored in a dedicated area of your Device’s hard drive (e.g. computer, tablet, smartphone, etc.) by the browser software that you use to view our Site, subject to your choices. The Cookies that we issue enable us:

– to adapt our advertising spaces to your device’s display preferences (language used, display resolution, operating system used, etc.), according to the viewing or reading hardware and software on your device;
– to adapt the advertising content displayed on your device in our advertising spaces according to your device’s browsing activity on our site;
– to adapt the advertising content displayed on your device in our advertising spaces according to location data (longitude and latitude) transmitted by your device with your prior consent
– insofar as you have provided us with personal data concerning you, in particular your electronic contact details, when registering or accessing one of our services, to combine this data with browsing information relating to your device in order, for example, to send you electronic marketing communications or display on your device, within advertising spaces that we provide, personalised advertisements specifically intended for you and likely to be of personal interest to you;
– to store information relating to a form that you have completed on our Site (registration or access to your account) or to products, services or information that you have chosen on our Site (service subscribed to, contents of an order basket, etc.);
– to enable you to access restricted and personal areas of our Site, such as your account, using identifiers or data that you may previously have entrusted to us;

These “fingerprint” trackers, combined with your Order data, are used to validate your Order, the payment method used and your delivery method.

In addition, on abayafemme.com, these cookies also enable us:

4.3 Cookies issued on our site by third parties

4.3.1 Cookies issued as a result of third-party applications integrated into our Site

4.6 If you share the use of your device with other people

5.Social media sharing functionality

You may share certain information or content (product page, etc.) found on abayafemme.com on social networks. This publication is accompanied by wording written by AbayaFemme, but which may be customised. By clicking the “Like”, “Share on Facebook” or any other social network sharing button (Twitter’s “bird”, Pinterest’s “P”), the content is exported from AbayaFemme’s servers and sent (Uploaded) to the website of the social network concerned. This use is then governed by the terms of use of that social network, which we invite you to consult. Content exported from our Site to social networks is exported entirely at your own risk.
