1.General information
Through its Site, UnHijab may collect personal data provided in particular when an account is created on our site, Orders are placed, users register for our loyalty programme, reviews are written or Posts are published on our social networks.
This automated processing of information, in particular the management of visitors’ email addresses, has been declared to the CNIL (declaration No. 1988754 v 0).
The personal data collected by UnHijab is collected, processed, recorded and stored in accordance with the legal provisions in force in France.
2.Rights of access, rectification, deletion and objection to processing
You have a right of access, rectification and objection on legitimate grounds in respect of personal information concerning you, as well as the option to object to processing for direct marketing purposes, particularly commercial marketing. You may exercise these rights at any time by writing to UnHijab Customer Services at: our contact form
– or via the unsubscribe link at the bottom of each email sent by UnHijab.
In accordance with the aforementioned French Data Protection Act, such requests for access, rectification or objection must be made by means of a letter (email) signed by its author and accompanied by a photocopy of an identity document bearing the signature of the person exercising their right.
If you encounter a problem in this regard, you may contact UnHijab Customer Services using the contact details provided above.
3.Management of personal data by our company
3.1 Methods of collecting data
When you register on the Site, we collect personally identifiable data using the form available under “create an account”. UnHijab may thus collect your surname, first name, date of birth, email address and IP address (or the UDID of your mobile phone, where applicable). Only your title, first name, surname and email address are mandatory data for processing your registration. In addition, we may ask you to provide optional information such as your product/service preferences.
When placing an Order as defined in the Terms and Conditions of Sale, we collect personally identifiable data using the form available under “confirm order”. In this context, in addition to the data collected during registration and listed above, we collect: your postal address (billing and delivery addresses if different), your telephone number so that we can contact you in the event of a delivery problem, and information relating to the payment method (including bank card number and bank card holder). By ticking the box provided for this purpose, we may also retain your bank details (card type, card number, expiry date) so that you do not have to enter them again for future Orders. In this case, your bank card security code is not retained by UnHijab. You may also delete this information at any time by going to the “account” section. If your account data is not deleted, it remains on record until the bank card expires.
Subject to your rights, when you place an Order online, we may also collect information relating to the device used to place the Order (including the operating system used, the location of the machine and whether or not a proxy is used, etc.).
– If an Order is paid for at the till in a “UnHijab Flash” shop, in order to guarantee the confidentiality of your personally identifiable data, this data is collected directly by our sales advisers. They will ask you for the information required to pay for and deliver your Order, namely your surname, first name, email address and postal address.
You may, however, remove or amend this data in your account at any time.
Generally, the information that we collect and that is essential for us to respond to your requests is identified by an asterisk on collection forms or stated as such verbally when it is collected. If you do not complete these mandatory fields, we will be unable to respond to your requests.
Finally, when you request to view pages on the Site, UnHijab’s servers automatically recognise your computer’s IP address (this is the number that identifies each computer connected to the Internet. The IP address takes the following form: XXX.XXX.XXX.XXX, or your phone’s UDID (this is a number that identifies the phone model connected to the Internet. The UDID consists of forty characters)”).
3.2 Purposes
The personal data that we collect from you during any visit or Order is necessary for the use of the services offered on the Site and/or the management of your Order by UnHijab and its service providers, including the detection of online and payment fraud, the prevention and management of payment incidents (including unpaid amounts), the preservation of UnHijab’s rights in connection with its commercial activity and the management of the Loyalty Programme.
In addition, subject to your rights, your data may be used to inform you by email about products, services and offers provided by UnHijab.
Furthermore, we reserve the right to compile and publish generic information relating to the profiles of visitors to our site, without, however, including personally identifiable data such as visitors’ names and addresses.
We may also collect statistical information in order to understand how visitors use the Site (frequency with which the various Site pages are viewed, sales statistics and the origin of Site visitors, etc.).
Information relating to visitor profiles is retained by UnHijab and will only be used internally, particularly to conduct market research.
Finally, through UnHijab, a visitor who has expressly given prior consent may receive by email commercial offers concerning products or services supplied by UnHijab’s business partners or originating from them.
3.3 Data retention
Data is retained for a period that does not exceed the time necessary for the purposes for which it was collected.
3.4 Data recipients
The personal information provided is intended for UnHijab.
Personal data collected through the site may be transmitted to partner companies, in particular to enable the purposes set out above to be carried out, as well as to detect payment fraud, manage loyalty cards and manage marketing operations organised by UnHijab or its partners.
In particular, as part of efforts to combat online fraud, information relating to the Buyer’s Order, together with information relating to the Buyer’s device used to place the Order (including the operating system used, the location of the machine and whether or not a proxy is used), may be transmitted to any third party authorised by law or appointed by UnHijab solely for the purposes of verifying the Buyer’s identity, the validity of the Order, the payment method used and the proposed delivery.
Personal data – excluding photographs – may be transmitted to companies domiciled in countries that do not ensure an adequate level of protection within the meaning of Directive No. 95/46/CE. In this case, where possible, UnHijab enters into agreements with the recipients concerned to ensure an adequate level of protection, in accordance with the contractual clauses approved by the European Commission and the CNIL.
3.5 Data security and confidentiality
UnHijab has endeavoured to put in place all appropriate precautions to preserve the confidentiality and security of the personal data processed and to prevent it from being altered, damaged or destroyed, or accessed by unauthorised third parties. State-of-the-art technical and organisational security measures have been introduced, particularly with regard to information systems. However, the company does not control all the risks associated with the operation of the Internet and draws visitors’ attention to the possible risks inherent in its use and operation.
4.Cookies and connection trackers
4.1 What is a “Cookie”?
A “Cookie” or tracker is a text file that may be stored in a dedicated area of your Device’s hard drive (e.g. computer, tablet, smartphone, etc.) by the browser software that you use to view our Site, subject to your choices. This Cookie file enables its issuer to identify the Device on which it is stored for the duration of the Cookie’s validity or storage.
When you visit our Site, information relating to your Device’s browsing activity on our Site may be stored in “Cookie” files installed on your Device.
When you visit our Site for the first time and UnHijab plans to place a Cookie on your Device, we inform you of our use of cookies by means of an information banner. By continuing to browse the Site while this banner is displayed, you consent to our use of cookies.
However, you may change your cookie settings at any time (see 4.5 Your choices regarding cookies). Below you will find further information about cookies and how you can manage your cookie settings.
4.2 The Cookies that we issue on our site
When you connect to our Site, subject to your choices, we may install various cookies on your Device that enable us to recognise your Device’s browser for the period of validity of the cookie concerned.
The Cookies that we issue enable us:
– to compile statistics and volumes concerning visits to and use of the various elements comprising our Site (sections and content viewed, browsing paths), enabling us to improve the relevance and usability of our services;
– to count the total number of advertisements displayed by us in our advertising spaces, identify those advertisements, their respective number of displays, the number of users who clicked on each advertisement and, where applicable, the subsequent actions taken by those users on the pages to which those advertisements lead, in order to calculate the sums due to parties in the advertising distribution chain (communications agency, advertising sales house, distribution site/medium) and compile statistics;
– to adapt the presentation of our Site to your device’s display preferences (language used, display resolution, operating system used, etc.) during your visits to our Site, according to the viewing or reading hardware and software on your device;
– to adapt the advertising content on our Site according to your browsing activity, the purchases that you may make and/or the location data (longitude and latitude) transmitted by your device (with your prior consent),
– insofar as you have provided us with personal data, in particular your electronic contact details, when registering, placing your Order or accessing one of our services, to combine this data with browsing information in order, for example, to send you electronic marketing communications or display on your device, within advertising spaces that we provide, personalised advertisements specifically intended for you and likely to be of personal interest to you;
– to adapt our advertising spaces to your device’s display preferences (language used, display resolution, operating system used, etc.), according to the viewing or reading hardware and software on your device;
– to adapt the advertising content displayed on your device in our advertising spaces according to your device’s browsing activity on our site;
– to adapt the advertising content displayed on your device in our advertising spaces according to location data (longitude and latitude) transmitted by your device with your prior consent
– insofar as you have provided us with personal data concerning you, in particular your electronic contact details, when registering or accessing one of our services, to combine this data with browsing information relating to your device in order, for example, to send you electronic marketing communications or display on your device, within advertising spaces that we provide, personalised advertisements specifically intended for you and likely to be of personal interest to you;
– to store information relating to a form that you have completed on our Site (registration or access to your account) or to products, services or information that you have chosen on our Site (service subscribed to, contents of an order basket, etc.);
– to enable you to access restricted and personal areas of our Site, such as your account, using identifiers or data that you may previously have entrusted to us;
– to implement security measures, for example when you are asked to log in again to content or a service after a certain period of time.
– to combat online fraud (prevention of payment fraud, identity theft, etc.). In this respect, subject to your rights, UnHijab or its service providers acting on its behalf may place trackers in order to collect information relating to the device used to place the Order (including the operating system used, the location of the machine and whether or not a proxy is used, etc.). These “fingerprint” trackers, combined with your Order data, are used to validate your Order, the payment method used and your delivery method.
In addition, on abayafemme.com, these cookies also enable us:
– to count the total number of advertisements displayed by us in our advertising spaces, identify those advertisements, their respective number of displays, the number of users who clicked on each advertisement and, where applicable, the subsequent actions taken by those users on the pages to which those advertisements lead, and compile statistics;
– to adapt our advertising spaces to your Device’s display preferences (language used, display resolution, operating system used, etc.), according to the viewing or reading hardware and software on your device;
4.3 Cookies issued on our site by third parties
The issuing and use of cookies by third parties are subject to those third parties’ privacy protection policies. We inform you of the purpose of the cookies of which we are aware and the means available to you to make choices concerning those cookies.
4.3.1 Cookies issued as a result of third-party applications integrated into our Site
We may include on our Site software applications from third parties that enable you to share content from our Site with other people or to let those other people know that you have viewed or expressed an opinion about content on our Site. This is particularly the case with the “Share” and “Like” buttons from social networks (such as “Facebook”, “Twitter”, “Pinterest”, etc.).
The social network providing such an application button may identify you through that button, even if you have not used the button while viewing our Site. This is because this type of application button may enable the social network concerned to track your browsing activity on our Site simply because your account with the social network concerned was active on your Device (open session) while you browsed our Site.
We have no control over the process used by social networks to collect information relating to your browsing activity on our Site and associated with the personal data held by them. We invite you to consult the privacy protection policies of those social networks to learn the purposes, particularly advertising purposes, for which they use the browsing information that they may collect through these application buttons.
In particular, these privacy protection policies should enable you to exercise your choices with these social networks, particularly by configuring your user accounts on each of these networks.
4.3.2 Targeted advertising Cookies issued on abayafemme.com by third parties
The abayafemme.com website may contain cookies issued by third parties (communications agency, audience measurement company, targeted advertising provider, etc.) which enable those third parties, for the period of validity of those cookies:
– to collect browsing information relating to Devices viewing our Site,
– to determine advertising content solely for promoting the products and/or services offered on the abayafemme.com site that is likely to correspond to interests inferred from the previous browsing activity of the device concerned
4.4 What is the benefit of seeing advertisements tailored to your browsing activity?
Our aim is to show you the most relevant advertisements possible. To this end, cookie technology makes it possible to determine in real time which advertisement to display on a Device, according to its recent browsing activity on one or more sites or applications.
Your interest in the advertising content displayed on your Device when you visit a Site often determines that site’s advertising revenue, which enables it to operate its services, often provided to users free of charge. You would no doubt prefer to see advertisements that match your interests rather than advertisements that are of no interest to you.
Likewise, advertisers who wish their advertisements to be distributed are interested in displaying their offers to users who are likely to be most interested in them.
4.5 Your choices regarding cookies
Several options are available to you for managing cookies. Any settings that you apply may affect your Internet browsing and your conditions of access to certain services that require the use of Cookies.
You may choose at any time to express and amend your wishes regarding cookies by the means described below.
4.5.1 The choices offered by your browser software
You may configure your browser software so that cookies are stored on your Device or, conversely, rejected, either systematically or depending on their issuer. You may also configure your browser software so that you are asked whether to accept or reject cookies on each occasion before a cookie is likely to be stored on your device. For more information, see the section “How can you exercise your choices according to the browser you use?”
(a) Consent to Cookies
The storage of a cookie on a Device is essentially subject to the wishes of the Device’s user, which they may express and amend at any time and free of charge through the choices offered by their browser software.
If you have accepted the storage of cookies on your Device in your browser software, the cookies embedded in the pages and content that you have viewed may be stored temporarily in a dedicated area of your Device. They will be readable there only by their issuer.
(b) Refusal of Cookies
If you refuse to allow cookies to be stored on your Device, or if you delete those stored there, you will no longer be able to benefit from a number of features that are nevertheless necessary in order to browse certain areas of our Site. This would be the case if you attempted to access our content or services that require you to identify yourself. It would also be the case if we – or our service providers – were unable, for technical compatibility purposes, to recognise the type of browser used by your device, its language and display settings, or the country from which your Device appears to be connected to the Internet.
Where applicable, we accept no liability for the consequences associated with the impaired operation of our services resulting from UnHijab’s inability to store or access the cookies required for their operation that you have refused or deleted.
(c) How can you exercise your choices according to the browser you use?
For managing cookies and your choices, each browser is configured differently. This is described in your browser’s help menu, which will tell you how to change your cookie preferences.
4.5.3 “Flash”© cookies from “Adobe Flash Player”™
“Adobe Flash Player”™ is a software application that enables the rapid development of dynamic content using the “Flash” programming language. Flash (and applications of the same type) stores the settings, preferences and use of this content using technology similar to cookies. However, “Adobe Flash Player”™ manages this information and your choices through an interface different from that provided by your browser software.
Insofar as your device may display content developed using the Flash language, we invite you to access your Flash cookie management tools directly from the website http://www.adobe.com/fr/.
4.5.4 Choices expressed online through cross-industry platforms
With regard to abayafemme.com’s advertising cookies, you may also connect to the Youronlinechoices site, offered by digital advertising professionals brought together within the European association EDAA (European Digital Advertising Alliance) and managed in France by the Interactive Advertising Bureau France.
You can therefore learn which companies are registered on this platform and offer you the option to refuse or accept the cookies used by those companies to tailor the advertisements likely to be displayed on your device to your browsing information:www.youronlinechoices.com/fr/controler-ses-cookies/.
This European platform is shared by hundreds of online advertising professionals and provides a centralised interface that enables you to refuse or accept cookies that may be used to tailor advertisements likely to be displayed on your device to its browsing activity. Please note that this procedure will not prevent advertisements from being displayed on the websites that you visit. It will only block the technologies that enable advertisements to be tailored to your interests.
4.5.5 Device identification Cookies
For the purpose of securing transactions (combating online fraud), UnHijab or its service providers acting on its behalf may place “Fingerprint” trackers that enable information relating to the Device used to place the Order to be collected (including the operating system used, the location of the machine and whether or not a proxy is used, etc.). This information may be transmitted to any third party authorised by law or appointed by UnHijab solely for the purposes of verifying the Buyer’s identity, the validity of the Order, the payment method used and the proposed delivery.
You are informed of this collection by an information banner as soon as you arrive on the Site. By continuing to browse our Site after seeing this banner, you accept this collection. You may express your choice at any time by refusing cookies and selecting “no” on the bar:
4.6 If you share the use of your device with other people
If your device is used by several people and the same device has several browser applications, we cannot be certain that the services and advertisements intended for your Device correspond to your own use of that device rather than that of another user of the Device.
Where applicable, sharing the use of your Device with other people and configuring your browser settings regarding cookies are matters of your free choice and responsibility.
4.7 Personal data and browsing information
We may tailor the offers and advertisements intended for you to information relating to your Device’s browsing activity on abayafemme.com.
Insofar as you have provided us with personal data concerning you, in particular your electronic contact details, when registering or accessing one of our services, we may, subject to your choices, combine browsing information relating to your Device, processed by the cookies that we issue, with your personal data in order, for example, to send you electronic marketing communications or display on your Device, within advertising spaces containing cookies that we issue, personalised advertisements specifically intended for you and likely to be of personal interest to you.
You may ask us at any time to stop sending you advertisements or marketing communications tailored to your Device’s browsing information, by contacting us directly and free of charge, or by using the unsubscribe link included in any marketing communication that we may send you by email. Where applicable, any advertisements that you may continue to receive, unless you object to us, will no longer be tailored to your Device’s browsing activity.
For more information about cookies and their use, Visitors may consult the guidance from the Commission Nationale de l’Informatique et des Libertés at the following address: http://www.cnil.fr.
5.Social media sharing functionality
You may share certain information or content (product page, etc.) found on abayafemme.com on social networks. This publication is accompanied by wording written by UnHijab, but which may be customised. By clicking the “Like”, “Share on Facebook” or any other social network sharing button (Twitter’s “bird”, Pinterest’s “P”), the content is exported from UnHijab’s servers and sent (Uploaded) to the website of the social network concerned. This use is then governed by the terms of use of that social network, which we invite you to consult. Content exported from our Site to social networks is exported entirely at your own risk. Under no circumstances shall UnHijab be liable for any use, exploitation or action once the content has been exported from its site.
6.Use of data
UnHijab will neither transfer nor sell personal data to unaffiliated third parties that are not partners unless UnHijab has informed you in advance through notices, agreements or information available on the Site, unless you have expressly given your consent, or unless required by law.
If UnHijab is compelled by law or by a judge to disclose personal data concerning you, UnHijab undertakes, insofar as possible, to notify you (unless UnHijab reasonably considers that it is not authorised to do so, particularly in view of any legal or judicial obligations incumbent upon it).
Given the state of technology, particularly the technology generally applied to telecommunications networks, UnHijab cannot guarantee, in particular, the confidentiality, integrity or authentication of emails that you send to or receive from UnHijab.
